TERMS and CONDITIONS

Payment

Payment for products supplied shall be made in full by the Customer to SINCE Computers at the time of ordering, payment for services shall be made in full by the Customer to SINCE Computers at the time of delivery, unless otherwise agreed. Payments may be cash, bank cheque or direct deposit. Company cheques and personal cheques will not be accepted without prior arrangement and approval from SINCE Computers. Direct Deposits shall be made to the bank account indicated on the Tax Invoice provided by SINCE Computers. Invoice terms are available to approved clients only. Invoice payments shall be made in full by the Customer to SINCE Computers, within the approved term as advised by SINCE Computers.

Default in Payment

If the Customer defaults in payment to SINCE Computers, then; All monies owing by the Customer to SINCE Computers shall become due and payable forthwith without demand; and SINCE Computers may at its sole discretion suspend the provision of credit to the Customer until all amounts owing by the Customer have been paid in full. If the Customer fails to make payment to SINCE Computers when due, SINCE Computers may charge a late payment fee. SINCE Computers may also charge interest on the amount(s) due and owing, from the date it becomes due until the date of payment at the annual percentage rate equivalent to the rate prescribed from time to time pursuant to Section 94 of the Supreme Court Act of New South Wales, 1970 or any subsequent amending legislation.

Retention of Title

Title to the Products shall not pass to the Customer until all monies due and payable by the Customer to SINCE Computers have been paid in full. In the event that the Products are not paid for in full within these terms and conditions of sale or any other agreement between SINCE Computers and the Customer, then SINCE Computers may at any time, without notice enter any premises owned or occupied by the Customer where SINCE Computers believes the Products may be stored, and repossess the Products without being liable for any damage caused, and subsequently dispose of the Products at its discretion. In the event that monies are recovered in full, the Customer ceases to be liable to SINCE Computers for payment for the Products.

Returns

SINCE Computers will not accept return of goods unless prior written approval has been given by SINCE Computers in relation to same. Where such goods are returned those goods may be subject to a 15% restocking charge together with the cost of freight, which shall be at the expense of the Customer. No such returns can be accepted unless the invoice number is quoted prior to such return.

Liability

SINCE Computers accepts no responsibility or liability for the loss of the use of products, loss of time, inconvenience or any other loss or damage, direct or consequential or otherwise arising out of or related in any way to a defect in material or workmanship of the products or attributable to any conduct, negligence, fault or default of SINCE Computers.

Provision of Credit

The provision of credit/or the continued provision by SINCE Computers to the Customer from time to time, shall be at the absolute discretion of SINCE Computers. SINCE Computers may at its absolute discretion, at any time vary or cancel the credit facility available to the Customer, extend and/or continue to extend credit to the Customer subject to the provision of security in a form acceptable to SINCE Computers.

Waiver

No relaxation or indulgence granted by SINCE Computers to the Customer shall be deemed as a waiver of any rights of SINCE Computers in terms of this agreement.

Applicable Law

The Customer hereby agrees to these conditions and consents to the jurisdiction of the relevant New South Wales and Federal Laws for all actions, which may be instituted against it for recovery of any amounts owing to SINCE Computers.
